What Is Environmental Due Diligence?

Environmental Due Diligence (EDD) is a detailed pre-purchase inspection or research before signing a lease agreement for sites that have potentially been involved in HAIL land uses. When you're buying property or acquiring a business that needs to comply with local and regional regulations, it’s crucial that you understand the associated environmental liabilities upfront. An informed decision now can help you to avoid major costs and headaches later.

Environmental Due Diligence reports follow a similar process to our Preliminary Site Investigations, but are geared towards assessing the viability of your investment opportunity instead of securing resource consent. 

It quantifies the cost of returning land to its original value, free from contamination liabilities. This knowledge enables you to renegotiate the purchase price and deal terms to reflect the actual risks present.

This may include prearranged dataroom access where we can review historical aerials, property files, anecdotal accounts, historical investigation reports, and any other relevant documentation. If the dataroom is not available, we can source relevant information ourselves.

  • We then analyse the data to create a model highlighting potential hazard zones, receptors, and contamination pathways. This guides any further investigation - ensuring that our work is focused on the right areas.

  • In addition to understanding previous land use issues, we also assess how your proposed business activities align with local and regional regulations, pinpointing any potential non-compliance risks and the costs to address them.

  • If required, we will visit the proposed site to take a closer look and, where necessary, initiate further testing and analysis.

  • Reports will often include a key issues register that provides a high-level overview of contamination problems and the ballpark compliance, business disruption and residual liability costs associated with remediation.

  • With this critical information at hand, we work collaboratively with your appointed representatives to address the issues identified and support you in renegotiating purchase agreements accordingly.
